Sample ADOPTION CONTRACT  (NO, I have not adopted out a Komodo Dragon!!)

This adoption contract is based on contracts used Melissa Kaplan in her own reptile rescue efforts.

This contract is made between Bonnie Keller (VA Reptile Rescue, Inc)  and the Adopter of record,

1.The VA Reptile Rescue, Inc.  (hereafter called VaRR) agrees to give the Adopter title to, possession and control of the following animal(s) for so long as the Adopter complies with the terms of this contract and has paid the requested fees:

2.In return, as Adopter, I agree to the following for each of the animals adopted (initials indicate having read, understood, and agreed to the conditions below the initial):

A.To take this animal(s) to an experienced reptile and amphibian veterinarian within 30 days for a general physical examination. I understand that, unless otherwise specified in paragraph 4 below, this animal is in good general health at the time of adoption. I further understand that the stress that may occur as a result of the animal being moved from VaRR to its new location may cause stress-related illness or injury. If the animal does require medical treatment or medications, I will be fully responsible for these expenses, and will assure that such care as is needed is provided to the animal.

B.To follow the rules and regulations promulgated by the city and county in which this animal will be housed, and that if permits or other permissions are required, I will obtain them and will be responsible for any expenses incurred in relation to the permit process. If the animals is seized due to failure of Adopter to acquire the requisite permits, custody and ownership shall revert toVa Reptile Rescue.

C.To furnish the appropriate housing, food, water, light, heat, humidity, exercise and medical care to provide for this animal(s) in a devoted and humane manner. To assure proper care, I have or will immediately purchase or otherwise acquire a book or other information to learn how to properly care for this animal(s). I further understand that if the animal(s) I am adopting will be large when full grown, I will have to move this animal(s) into housing large enough to properly accommodate the growing animal(s) and its changing needs.

D. I specifically agree to keep this animal(s) primarily as a household animal(s) and to keep it within my control at all times. I understand that many snakes and lizards are able to escape from their housing; I will take particular care when housing such animal(s)s to ensure the enclosures are escape-proof and that, in the case of giant snakes and lizards, the room in which they are housed is secured against possible escape.  

E.I specifically agree, except as otherwise provided for in Paragraph 3, that this animal(s) will not be used for research or utilitarian or other purposes not consistent with maintaining this animal(s) as a household animal(s).

F.To keep the animal(s) until I decide to return it VaRR or obtain permission from them to sell or trade it. The animal(s) cannot be sold, traded, destroyed (except in cases of extreme medical conditions), abandoned or otherwise disposed of.

G.To return the animal(s) to VaRR  if, as Adopter, I no longer desire or am otherwise unable to keep the animal(s), and to not sell, trade, give away or abandon the animal(s). If the animal(s) is lost, I shall notify VaRR expeditiously and make every effort to recover it. If the animal(s) dies, VaRR is to be notified, and we may request that the body is to be frozen until such time as it can be delivered to or picked up by VaRR.

H.To allow VaRR at any time to investigate the premises where the animal is kept and to reclaim the animal if, in the judgment of the investigator, the animal is not being adequately cared for, if the Adopter has not complied with any provision of this contract, or if the Adopter has misrepresented any fact to VaRR. In the event that the Adopter fails or refuses to return such animal upon demand, the Adopter hereby agrees to pay reasonable attorney's fees in the event an attorney in consulted or if suit is brought for the return of the animal.

I.To truthfully and completely answer any follow-up questionnaire which VaRR may send the Adopter regarding the animal, and to provide VaRR with changes of address, phone #, etc. as is reasonable.

3.To the best of VaRR knowledge, the physical condition of these animal(s) at the time of adoption is:

4.The adopter understands that any specified condition(s) listed above exists, and agree to be fully and financially responsible for the extra care and treatment, including veterinary and related expenses, this condition may now, and in the future, require.

5.The Adopter agrees to be solely and personally responsible for this animal and to indemnify and hold harmless VaRR and its agents from any and all claims of liability for the conduct or condition of this animal after the date of this adoption. Adopter further agrees that this indemnification and release of liability shall apply to all known, unknown and unanticipated damages resulting from this adoption, or the ownership or control of this animal.

6. In the case of a prey-eating reptile (snakes, many lizards, etc.) that I will find a source for pre-killed prey items, and use only pre-killed prey in feeding this animal, unless documented medical conditions warrant the use of live prey.  I understand that failure to feed pre-killed prey may not only endanger the animal, but can cause the animal to become frightened of the prey items and lead to a refusal to eat.  Furthermore, failure to comply with this feeding requirement is cause for reclamation of the animal by VaRR. 

7. I understand that the animal(s) I am adopting may be classified as Threatened by the Endangered Species Act of the State of California, and/or the United States, and/or the Convention on International Trade in Endangered Species (CITES) and that permits or other documentation may be required to prove legal ownership or possession. I understand that certain other city, county, state or federal permits or licensing may be required and that I am fully responsible for researching and acquiring same. I further understand that failure on my part to secure such permits or documentation may result in the seizure of this animal by local, state or federal agencies, as well as reclamation by VaRR with no recourse.

8.  The adopter of record agrees to periodically review new information about the particular species adopted.  This includes areas on-line (Internet) as well as NEWLY published or revised books/magazine articles, etc.  Examples:  

* Melissa Kaplans’s online Herp Care Web site at: http://www.anapsid.org  

* A subscription to any of the leading herptile-oriented magazines such as Reptiles, etc.

9. Adopter agrees that if the animal(s) adopted has not been approved for breeding purposes (see top of contract), that no such breeding shall occur; if breeding is done for medical reasons (i.e., preventing egg-impaction, etc.) that the resulting eggs shall be destroyed as soon as possible.

10 By signing below you are certifying that all the answers to the questions asked on the original adoption application are true to the best of your knowledge. Anything which is found to not be true may be cause for revoking the adoption agreement, and that the adoptor would be responsible for costs involved in returning the animal to VARR. Further, you certify that neither you nor any co-applicant, have ever been convicted of any crime relating to the abuse, cruelty, or neglect of another person or any animal.  If you are under 18, a parent or legal guardian must sign as an indication of their consent and willingness to care for the animal(s) themselves if the need arises.
